Interpretación conforme como método de solución a problemas en el sistema jurídico mexicano

Abstract

The current investigation exposes the way in which conforming interpretation can be used as a method to solve legal issues Mexican law system, this means that the present document grants conforming interpretation the hability to avoid any norm questioning its constitutionality and to expell them from the legal system without creating legal voids in any hypothesis of human behaviour, in other words, conforming interpretation adjusts the norms to the legal system respecting at all times the legislatur’s work and the presumption of it’s constitutionality investment, this task will be performed base on constitutional postulates, so the norms will be always compatible with the Supreme Law.

El presente trabajo expone la manera en que la interpretación conforme puede ser usada como método para la solución a los problemas en el sistema jurídico mexicano, esto es que dentro del presente trabajo, la función que se le otorga a la interpretación conforme es evitar que las normas a las cuales se les cuestione su constitucionalidad, sean expulsadas del sistema jurídico y con ello no se genere un vacío legal que deje sin regular una hipótesis del comportamiento humano en sociedad, en otras palabras armonice el sistema jurídico; en ese sentido la interpretación conforme adecua a la norma dentro del sistema jurídico, respetando en todo momento el reflejo de la obra del legislador y la presunción de constitucionalidad que las enviste, tarea que realizará tomando como base los postulados constitucionales, para que las normas sean en forma y fondo compatibles con la Ley Suprema.
