Implementación de la jurisdicción constitucional local en Michoacán

Abstract

The following thesis aims to make a series of reflections on a topic of capital importance in legal studies today, the defense of the State Constitution of Michoacán, the issue of local constitutional control has entered into vogue at the beginning of this century where The State of Veracruz is a pioneer and subsequently several federal entities are taking part and including mechanisms of local constitutional control This research will focus on the analysis of federalism, especially in regard to the distribution of competencies in the jurisdictional field. The articulation of the Mexican Republic as a federal State imposes a peculiar ordering of the sources of the Law while granting to the federated entities a constitutionally guaranteed space, with greater or lesser extent, as will be seen, of "regulatory autonomy" differentiated from that pertaining to the Federation The constitutional theory will be approached which includes the one referred to the supreme legal institution that is the Fundamental Norm of the State. Therefore, the Constitution is the condition of the state unit resulting from the decision and action unit, since "the Positive Law" is the social normative order established and guaranteed by the state organization. In addition to the theory of constitutional jurisdictional control in its different meanings. We will introduce a brief historical as well as legal analysis of the means of constitutional control both jurisdictional and non-jurisdictional at the federal and local levels. The local constitutional control means will be conceptualized and subsequently carried out a comparative study of those federal entities that already contemplate this system. Finally, what corresponds to the constitutional control is approached from a local point of view in Michoacán, attending to the appropriate control means, the ad hoc magistracy and the adequate guarantees, establishing the budgets to implement it, the challenges to be fulfilled so that it materializes and culminating in an initiative to reform and add to said Constitution.

La siguiente tesis tiene como objeto realizar una serie de reflexiones sobre un tema de importancia capital en los estudios jurídicos en la actualidad, la defensa de la Constitución Estatal de Michoacán, el tema de control constitucional local ha entrado en boga a inicios del presente siglo donde el Estado de Veracruz es pionero y posteriormente varias entidades federativas van tomando parte e incluyendo mecanismos de control constitucional local La presente investigación se centrará en el análisis del federalismo en especial en lo que respecta a la distribución de competencias en el ámbito jurisdiccional. La articulación de la República mexicana como un Estado federal impone una ordenación peculiar de las fuentes del Derecho en tanto otorga a los entes federados un espacio constitucionalmente garantizado, con mayor o menor amplitud, según se verá, de "autonomía normativa" diferenciado del perteneciente a la Federación. Se abordará la teoría constitucional la cual recoge la referida a la institución jurídica suprema que es la Norma Fundamental del Estado. Por consiguiente, es la Constitución la condición de la unidad estatal resultante de la unidad de decisión y acción, ya que "el Derecho Positivo" es la ordenación normativa social establecida y garantizada por la organización estatal. Además de la teoría del control constitucional jurisdiccional en sus distintas acepciones. Introduciremos un breve análisis histórico, así como jurídico de los medios de control constitucional tanto jurisdiccionales como no jurisdiccionales a nivel federal y local. Se procederá a conceptualizar los medios de control constitucional locales y posteriormente a realizar un estudio comparativo de aquellas entidades federativas que ya contemplan este sistema. Finalmente se aborda lo que corresponde al control constitucional desde un punto de vista local en Michoacán, atendiendo a los medios de control idóneos, la magistratura ad hoc y las garantías adecuadas, estableciendo los presupuestos para implementarlo, los retos a cumplir para que se materialice y culminando con una iniciativa de reforma y adición a dicha Constitución.
