El tribunal eclesiástico, la superstición y las prácticas médicas en los juicios contra hechiceros y curanderos en el obispado de Michoacán, 1777-1797

Abstract

This thesis is intended to analyze how the Ordinary Court worked in the witchcraft trials in Tarímbaro, San Mateo and Patamban of the bishopric of Michoacán during 1777-1797. At the beginning we took as a study the statutes of the Third and Fourth Provincial Council of Mexico to understand the legal status of the Indian followed by analyzing the Ordinary Court, its composition, jurisdiction and trials. We took as a tool of study the concept of superstition and what were the religious and institutional implications of the implicit and explicit pacts with the devil. We analyzed three trials where we tried to identify the judicial process that the Ordinary Court was to follow, the methods that the auxiliary judges made use of during the summary phase and the position of the bishop regarding the crimes of faith.

Esta tesis tiene la intención de analizar cómo funcionó el Tribunal Ordinario en los juicios por hechicería en Tarímbaro, San Mateo y Patamban del obispado de Michoacán durante 1777-1797. En un inicio tomamos como estudio los estatutos del Tercer y Cuarto Concilio Provincial Mexicano para comprender la condición jurídica del indio seguido de analizar el Tribunal Ordinario, su composición, jurisdicción y los juicios. Tomamos como herramienta de estudio el concepto de superstición y cuáles eran las implicaciones religiosas e institucionales de los pactos implícitos y explícitos con el diablo. Analizamos tres juicios donde procuramos identificar el proceso judicial que debía seguir el Tribunal Ordinario, los métodos que los jueces auxiliares.
