Tratamiento fiscal de una notaría

Abstract

A notary or clerk is the public official authorized to give evidence, in accordance with the laws, of contracts and other extrajudicial acts. He is a special figure, direct heir of the old scribes dedicated to advise, to write, to guard and to give faith in agreements, documents, wills and other civil and mercantile acts. He is obliged to control and present the law and to maintain neutrality in his actions. The Notary is a legal professional who performs public functions within the framework of non-contentious activities established by the State and fulfills numerous social functions within the scope of the national social order, and for this purpose is a public officer and autonomous delegate of public authority of the State. The public and social functions of the Notary are, in a very particular way, at the service of the respect and safeguard of the legality and maintenance of the legal security and of the equity. The Notary performs his functions by establishing authentic acts with probative and enforceable force, providing on the one hand, a service of consultation and complete legal assistance to the citizen, the latter activities being intimately linked to authentication, as well as compliance with judicial acts within of the framework of the voluntary jurisdiction, with which the Notary thus contributes to streamlining the judicial power of the State. The Notary performs his public functions in an impartial manner, keeping professional secrecy as well as his substantial, economic and personal independence within a framework of a specifically regulated liberal profession, contributing his specific contribution to consumer protection.

Un notario o escribano es el funcionario público autorizado para dar fe, conforme a las leyes, de los contratos y demás actos extrajudiciales. Es una figura especial, heredero directo de los antiguos escribanos dedicados a asesorar, redactar, custodiar y dar fe en acuerdos, documentos, testamentos y otros actos civiles y mercantiles. Está obligado a controlar y presentar la ley y mantener la neutralidad en sus actos. El Notario es un profesional del derecho que ejerce funciones públicas en el marco de actividades no contenciosas instauradas por el Estado y cumple numerosas funciones sociales en el ámbito del orden social nacional, y con este fin es un oficial público y delegado autónomo de la autoridad pública del Estado. Las funciones públicas y sociales del Notariado están, de un modo muy particular, al servicio del respeto y salvaguarda de la legalidad y mantenimiento de la seguridad jurídica y de la equidad. El Notario ejerce sus funciones estableciendo actos auténticos provistos de fuerza probatoria y ejecutoria, prestando por una parte, un servicio de consulta y de asistencia jurídica completa al ciudadano, estando estas últimas actividades íntimamente ligadas a la autentificación, así como al cumplimiento de actos judiciales dentro del marco de la jurisdicción voluntaria, con lo que el Notario contribuye así a agilizar el poder judicial del Estado. El Notario ejerce sus funciones públicas de manera imparcial, guardando el secreto profesional así como su independencia sustancial, económica y personal en un marco de una profesión liberal específicamente regulada, aportando su contribución específica a la protección del consumidor.
