Resumen : Bad governmental decisions and practices have a trans-territorial effect on the dignity of migrants, since they not only affect those who are in national territory and therefore must be protected in accordance with the regulations in force in the Mexican State, but they also harm Mexicans living in foreign territories who are violated in their human rights by the passivity of those who are obliged to provide assistance to them. Although respect for human rights, including the rights of migrants, in Mexico acts as an instrument of political legitimacy, the institutions in charge of implementing existing legislation in government activity lack adequate institutional structures, clear quantitative instruments for monitoring results and relevant bureaucratic processes that allow for the effective implementation of public policy objectives in the sector. In addition to the above, the lack of political will of the ruling class has prevented taking advantage of citizen participation and the experience of other countries in the ideation of solutions congruent with the obligations contracted and the expectations raised. The main objective of the research is to identify the institutional structures and failed bureaucratic processes that generate negative results in the protection of the human rights of migrants, since it is assumed that once they can be clearly identified, it will be feasible to develop an appropriate public policy strategy to correct them.
Las malas decisiones y prácticas gubernamentales tienen un efecto transterritorial en la dignidad de los migrantes, puesto que no sólo afectan a quienes se encuentran en territorio nacional y por tanto deben ser protegidos conforme a la normatividad vigente en el Estado Mexicano, sino que perjudican a los mexicanos que radicando en territorios extranjeros se ven violentados en sus derechos humanos por la pasividad de quienes están obligados a proveerles asistencia. Pese a que el respeto a los derechos humanos, entre ellos los de los migrantes, en México funge como un instrumento de legitimación política, las instituciones encargadas de materializar en la actividad gubernamental la legislación existente carecen de estructuras institucionales adecuadas, de instrumentos cuantitativos claros para monitorear los resultados y de procesos burocráticos pertinentes que permitan llevar a la práctica de manera eficaz los objetivos de política pública en el sector. Aunado a lo anterior, la falta de voluntad política de la clase gobernante ha impedido aprovechar la participación ciudadana y la experiencia de otros países en la ideación de soluciones congruentes con las obligaciones contraídas y las expectativas planteadas. El principal objetivo de la investigación es el de identificar las estructuras institucionales y los procesos burocráticos fallidos que generan los resultados negativos en materia de protección de los derechos humanos de los migrantes, puesto que se parte de la hipótesis de que una vez que sea posible determinarlos con claridad, será factible elaborar una estrategia de política pública apropiada para corregirlos.
