Determinación del ingreso por indemnización y finiquito de una persona asalariada que laboró por tiempo indeterminado y fue despedida injustificadamente

Abstract

With the separation of the worker from his employment, rights and obligations that have both the worker and the employer for the termination of the employment relationship emerge. That is why this paper deals with the persons involved in an employment relationship, the essential elements of it, the causes that may lead to termination of employment by the worker can be separated from his work, and therefore the compensation to which the employee becomes entitled under the law. Also it specifies the revenue must obtain the worker, which does not correspond precisely to their compensation, but those revenues to which it is entitled by the time he was laboring, ie the settlement to which you are entitled.

Con la separación del trabajador de su empleo, se desprenden los derechos así como obligaciones que se tienen tanto el trabajador como el patrón por la rescisión de la relación laboral. Es por ello que el presente trabajo trata de los sujetos que intervienen en una relación laboral, los elementos esenciales de la misma, las causas que pueden dar origen a la rescisión de la relación laboral por las que el trabajador puede ser separado de su trabajo, y por consiguiente la indemnización a la que se hace acreedor el trabajador de acuerdo a la ley. También se determinarán los ingresos que debe obtener el trabajador, los cuales no corresponden precisamente a su indemnización, sino a aquellos ingresos a los que tiene derecho por el tiempo que estuvo laborando, es decir el finiquito a que tiene derecho.
