Importancia y trascendencia de contar con un comité de ética y prevención de conflictos de intereses para propiciar la integridad de los servidores públicos en la Secretaría de Salud y Bienestar Social del estado de Colima

Abstract

The purpose of this thesis is to analyze and demonstrate the importance and transcendence of having a committee of Ethics and Prevention of conflicts of interest, as a means to promote the integrity of the public servants in the Ministry of Health and Social Welfare of the State of Colima. First, it starts with the need to improve the operation of public institutions, by accompanying ethical principles and values, as a social requirement and the promulgation of new legal systems that establish the Codes of Ethics as mechanisms for the prevention, correction and investigation of administrative responsibilities. The second part refers to the theoretical framework, definitions of ethics, conceptualization and identification of principles and values, public ethics, articulation between the Code of Ethics and the Public Administration, and the conception of a code of conduct that specifically orients the behavior of the public servants attached to the Ministry of Health and Social Welfare of the state of Colima. The fundamental aspects of the Ethics Committees (third part) refer to the general guidelines for their integration, operation and attention to complaints. Part four investigates the causes of non-compliance with the Code of Ethics, reflections on public ethics against corruption, the need to strengthen public institutions and the usefulness of ethics committees to transform public management. And finally, the results of this approach and the final conclusions are presented.

El propósito de esta Tesis es analizar y demostrar la importancia y trascendencia de contar con un Comité de Ética y de prevención de Conflictos de Intereses, como medio para propiciar la integridad de los Servidores Públicos en la Secretaría de Salud y Bienestar Social del Estado de Colima. Primero, se parte de la necesidad de mejorar la operación de las instituciones públicas, mediante el acompañamiento de principios y valores éticos, como una exigencia social; y la promulgación de nuevos ordenamientos legales que establecen a los Códigos de Ética como mecanismos para la prevención, corrección e investigación de responsabilidades administrativas. La segunda parte refiere el marco teórico, definiciones de la ética, conceptualización e identificación de los principios y valores, la ética pública, la articulación entre el Código de Ética y la Administración Pública, y la concepción de un Código de Conducta que oriente específicamente el comportamiento de los servidores públicos adscritos a la Secretaría de Salud y Bienestar Social del Estado de Colima. Los aspectos fundamentales de los Comités de Ética (tercera parte) se refieren a los lineamientos Generales para su integración, funcionamiento y atención de quejas. La cuarta parte, investiga las causas que originan el incumplimiento del Código de Ética, reflexiones sobre la ética pública frente a la corrupción, la necesidad de fortalecer las instituciones públicas y la utilidad de los Comités de ética para transformar la gestión pública.
