Pandemia y derechos humanos: análisis a la luz de la impartición y administración de justicia

Abstract

Due to the COVID-19 pandemics, State authorities adopted several measures in order to safeguard the life of citizens. Concerning the right bot access to justice, at the local level, the state of Michoacan Council of Judicature called for a suspension of the judicial branch activities, aiming to protect the health of both its personal and justice seeking citizens. The purpose of this research is to analyze the preventive sanitarian measure adopted by the Michoacan Judicature, taking into consideration the congrative experience of the Spanish Judicial Branch which anti-COVID-19 policy set a model to tackle this problematic issue. Such approach aims to identify the good practice that guarantees both the human right to health and the human right to access to justice.

Durante la pandemia ocasionada por el COVID-19, el Estado tomó una serie de medidas para salvaguardar, primordialmente, el derecho a la vida de la ciudadanía. En materia de acceso e impartición de justicia, el Consejo de la Judicatura del Poder Judicial del Estado de Michoacán suspendió sus actividades cotidianas con el fin de proteger el derecho a la salud, tanto de sus trabajadores como de sus usuarios. El propósito de esta investigación es analizar las acciones preventivas sanitarias adoptadas por el Poder Judicial de Michoacán, teniendo como referencia al Poder Judicial español, el cual se caracteriza por las medidas ejemplares tomadas durante la crisis ocasionada por el COVID-19, a fin de identificar las buenas prácticas en aras de garantizar tanto el derecho humano a la salud como el derecho humano al acceso e impartición de justicia.
