Los derechos humanos de los menores en Michoacán: el caso de los centros de asistencia

Abstract

This project is focused on the Social Assistance Centers (CAS) of the State of Michoacán, Mexico, where children and adolescents in situation of violence are sheltered, these centers protect the integrity of the children who live in CAS, as well as guarantee their human rights, prioritizing in this investigation the right to education. This investigation integrates three chapters and a section of annexes; The first section covers the historical trajectory of education in Mexico, the socializing and cultural mechanisms, as well as the emergence of the first educational institution aimed at orphaned girls; in chapter two, the normative support that recognizes children as subjects of law is explored, as well as the obligations that the State has on them to exercise their rights, guaranteeing the healthy integral development of each one of them through their mechanisms; on chapter three, called Social Assistance Centers, describes the operation and functionality of the assistance centers, as well as the obligations that they maintain as mechanisms that safeguard the integrity of children, mention is made of the regulations that govern them. Finally, we briefly expose the limitations that we found for carrying out field research concerning this area as well as the absence and difficulty in accessing reliable data regarding the CAS, which affected the realization of this project.

Este proyecto de investigación está enfocado en los Centros de Asistencia Social del Estado de Michoacán de Ocampo, donde se resguardan niñas, niños y adolescentes en situación de violencia, estos Centros se encargan de salvaguardar la integridad de la niñez que habitan en los llamados CAS, así como en garantizar sus Derechos Humanos, priorizando en esta investigación su derecho a la educación. Esta investigación integra tres capítulos y un apartado de anexos; el primer apartado abarca la trayectoria histórica de la educación en México, los mecanismos socializadores y culturales, así como el surgimiento de la primera institución educativa dirigida a niñas huérfanas; en el capítulo dos se explora el sustento normativo que reconoce a las y los niños como sujetos de derecho, así como las obligaciones que tiene el Estado sobre éstos para ejercer sus derechos, garantizando el sano desarrollo integral de cada uno de ellos a través de sus mecanismos; el capítulo tres que lleva por nombre Centros de Asistencia social, describe el funcionamiento y funcionalidad de los centros asistenciales, así como las obligaciones que mantienen al ser mecanismos que salvaguardan la integridad de las y los niños, se hace mención de la normativa que los rige. Finalmente, exponemos de forma breve las limitantes que encontramos para la realización de investigación de campo concerniente a esta área, así como la ausencia y dificultad para acceder a datos fidedignos respecto a los CAS, lo que afectó la realización de este proyecto.
