Análisis del derecho de acceso a la justicia en el poder judicial del Estado de Michoacán durante la pandemia del virus SARS-COV-2. Estudio comparado con España y su gobierno digital

Abstract

The objective of this research was to analyze the actions implemented in Spain and Mexico in the area of justice delivery during the pandemic of the Sars Cov2 virus, as well as to identify those mechanisms that can serve as a basis to guarantee the right of access to justice in the Judicial Branch of the State of Michoacán in pandemic situations. The methodological design of this study is based on the qualitative paradigm based on the data collection technique (collected references), and a descriptive content analysis. The operations of analysis, synthesis, deduction and induction were carried out, applied to the examination of texts, doctrine, law, jurisprudence and comparative law. The study reveals the Spanish State as a worldwide reference, as it has an online justice system that has permeated much of its legislation, as well as legal institutions that carry out their procedures digitally, as is the case of the organs of administration of justice, which have platforms and infrastructure that has allowed the generation of a solid digital system that has worked adequately even during the Covid-19 pandemic.

La presente investigación tuvo como objetivo analizar las acciones implementadas en España y México en el ámbito de impartición de justicia durante pandemia del virus SARS Cov2, así como identificar aquellos mecanismos que puedan servir de base para garantizar el derecho de acceso a la justicia en el Poder Judicial del Estado de Michoacán en situaciones de pandemia. El diseño metodológico del presente estudio parte del paradigma cualitativo basado en la técnica de recolección de datos (referencias recopiladas), y de un análisis de contenido de corte descriptivo. Se realizaron las operaciones de análisis, síntesis, deducción e inducción, aplicadas al examen de textos, doctrina, ley, jurisprudencia y derecho comparado. El estudio revela al Estado español como un referente a nivel mundial, al contar con un sistema de justicia en línea que ha permeado en gran parte de su legislación, así como con instituciones jurídicas que realizan sus trámites vía digital, como es el caso de los órganos de impartición de justicia, que cuentan con plataformas e infraestructura que ha permitido que sea de paso a la generación de un sistema digital sólido que ha funcionado adecuadamente incluso durante la pandemia por Covid-19.
