Las causas jurídico-sociológicas del ocaso del matrimonio civil en México

Abstract

Today, no matter how much one wants to have a traditionalist, romantic and conservative vision of civil marriage, it is not possible. It is imperative to postulate that this ancient legal institution has reached its decline, giving way to new forms of erotic-affective coexistence. The main reasons that support this postulate are found in legal and sociological causes, which have relegated traditional marriage to a frankly twilight position. Among these causes it is possible to highlight the following: the restructuring of the marriage archetype, the evolution of the purposes of marriage, the emergence of analogous legal figures, the legal reconfiguration of divorce, the free development of the personality, models of marital organization, the virtual marriage market, the deconstruction of romantic love, the expansion of the labor market, the impact of gender theories and the new realities of affective bonds.

Hoy, por más que se quiera tener una visión tradicionalista, romántica y conservadora del matrimonio civil, no se puede. Es imperioso postular que esta antiquísima institución jurídica llegó a su ocaso, dando paso a nuevas formas de convivencia erótico-afectivas. Las principales razones que fundamentan este postulado se encuentran en causas de índole jurídico y sociológico, mismas que han relegado el matrimonio tradicional a una posición francamente crepuscular. Entre estas causas es posible destacar las siguientes: la restructura del arquetipo matrimonial, la evolución de los fines del matrimonio, el surgimiento de figuras jurídicas análogas, la reconfiguración jurídica del divorcio, el libre desarrollo de la personalidad, los modelos de organización conyugal, el mercado matrimonial virtual, la deconstrucción del amor romántico, la expansión del mercado laboral, el impacto de las teorías de género y las nuevas realidades de los vínculos afectivos.
