Abstract: This research studies the dynamics associated with the problem of law enforcement and justice, by analyzing the intra-ethnic and inter-ethnic disputes that occurred in the peninsula of La Guajira between 1831 and 1840. It studies the relations established between the social groups who inhabited this border area during the second half of the eighteenth century, which included alliances, negotiations and conflicts. In addition, policies implemented by the Spanish Crown to regain control of this area are examined. On the other hand, it shows how the Republican context neogranadino State implemented aimed at monitoring commercial and civil relations between indigenous and non-indigenous standards, given the dilemma faced by provincial authorities Riohacha to administer justice in situations involving Guajiro Indians. Finally, it is shown that to maintain harmony and peace both native territory and province, there were diplomatic ways that lead to a resolution, negotiated, disputes between indigenous and non-indigenous.
La presente investigación estudia las dinámicas asociadas al problema de la aplicación de la ley y justicia, mediante el análisis de las disputas intraétnicas e interétnicas que acontecieron en la península de La Guajira entre 1831 y 1840. Se estudian las relaciones que se establecieron entre los grupos sociales que habitaban este espacio fronterizo durante la segunda mitad del siglo XVIII, las cuales incluyeron alianzas, negociaciones y conflictos. Además, se examinan las políticas que implementó la Corona española para retomar el control de ésta área. Por otra parte, se muestra cómo en el contexto republicano el Estado neogranadino puso en práctica normas orientadas a vigilar las relaciones comerciales y civiles entre indígenas y no indígenas, dado el dilema que enfrentaban las autoridades provinciales de Riohacha al administrar justicia en situaciones que involucraban a los nativos guajiros. Finalmente, se demuestra que para mantener la armonía y la paz tanto en territorio nativo como en territorio provincial, se produjeron formas diplomáticas que permitieron resolver, de manera negociada, las disputas entre indígenas y no indígenas.
