La intervención judicial en el ciclo de las políticas públicas en materia de acceso a la salud en México

Abstract

The judicial system participates in the process of public policies through the effect of its resolutions. These resolutions may impose, veto, modify or even extinguish various policies, especially in human rights. Therefore, the objective of the present investigation is to know how the resolutions of the judicial system affect the cycle of the public policies in terms of access to health in Mexico. In order to understand the scope and limits of the judicial authority in the mentioned subject, the present investigation starts from a mixed analysis, combining approaches of both the quantitative and qualitative method. It is firstly used the content analysis of the judicial decisions through a matrix, later, through their interpretation through descriptive statistics, it was possible to determine the level of influence of judicial decisions in two fundamental aspects: first, at the general level, which determines the level of influence or interference of judicial decisions in all the cycle of policies, and secondly, at the individual level, which allows us to know the level of influence of resolutions at each stage of the cycle. In the light of the foregoing, it was possible to note that judicial decisions on human rights, specifically on access to health, insufficiently affect the entire policy cycle. Regarding the stage involvement, the most affected by judicial intervention, in the first place: the formation of the agenda, the definition of the problem, and the construction or elaboration of the solution. The next most affected stage by judicial decisions is the implementation, and finally, the stage less affected is evaluation.

El sistema judicial participa en el proceso de las políticas públicas mediante el efecto de sus resoluciones, las cuales pueden imponer, vetar, modificar o incluso extinguir diversas políticas, sobre todo en lo que compete al tema de derechos humanos. Por lo anterior, el objetivo de la presente investigación es conocer el modo en que las resoluciones del sistema judicial afectan al ciclo de las políticas públicas en materia de acceso a la salud en México. Para conocer los alcances y límites de la autoridad judicial en el tema señalado, la presente investigación parte de un análisis mixto, combinando enfoques tanto del método cuantitativo como cualitativo. Se utiliza primeramente el análisis de contenido de las resoluciones judiciales a través de una matriz, posteriormente, gracias a la interpretación de estos a través de estadística descriptiva, fue posible determinar el nivel de influencia de las resoluciones judiciales en dos aspectos fundamentales: primeramente a nivel general, que determina el nivel de influencia o injerencia de las resoluciones judiciales en todo el ciclo de las políticas, y, en segundo lugar, a nivel individual, que permite conocer el nivel de influencia de las resoluciones, en cada una de las etapas del ciclo. Hecho lo anterior, fue posible advertir que las resoluciones judiciales en materia de derechos humanos, específicamente en acceso a la salud, afectan de forma insuficiente a la totalidad del ciclo de las políticas. En cuanto a la afectación por etapas, las más afectadas por la intervención judicial son, en primer lugar: la formación de la agenda, la definición del problema, y, la construcción o elaboración de la solución. La siguiente etapa en verse mayormente afectada por las resoluciones judiciales es la implementación, y finalmente, la etapa menos afectada es la evaluación.
