Estudio de la tutela del interés difuso y su relación con los derechos sociales

Abstract

One of the most current issues in legal matters is undoubtedly the diffuse rights or interests, which by its recent appearance on the scene is still a little explored field. Diffuse interests have been shaped in such a way as to take account of the development that human rights have had in recent years. Hence, given the lack of studies on diffuse interests, we consider it appropriate to assign this work to the study of them, this issue raises a series of questions that will be resolved at the time, starting at the beginning, since these They are often referred to as diffuse rights, group interests, social interests, collective interests, supra-individual interests, class interests, and so on. For some writers diffuse rights are a kind of collective rights, while in some countries the law handles them indistinctly, while others point out that the denomination is incorrect and that therefore the right is interest, not without first doing A long list of interests since it is certainly not the same as a public interest that a private one and that the latter can be subjective or legitimate, so trying to make a study of the "legally protected" we will see that the conceptualization occupies a rank Inferior when the truly relevant is that regardless of knowing the title or denomination of the right that we consider has been upset and violated. Uno de los temas de mayor actualidad en materia jurídica es sin duda el de los derechos o intereses difusos, mismos que por su reciente aparición en escena sigue siendo un campo poco explorado. Los intereses difusos han logrado perfilarse de tal forma en atención al desarrollo que los derechos humanos han tenido en los últimos años. De ahí que ante la falta de estudios en materia de intereses difusos, consideramos atinado destinar este trabajo al estudio de los mismos, dicho tema nos plantea una serie de cuestionamientos que en su momento se irán resolviendo, de inicio el nominal, ya que a éstos se les suele denominar de manera indistinta derechos difusos, intereses de grupo, intereses sociales, intereses colectivos, intereses supraindividuales, intereses de clases, etcétera. Para algunos tratadistas los derechos difusos son una especie de los derechos colectivos, mientras que en algunos países la legislación los maneja de manera indistinta, mientras que otros señalan que la denominación es incorrecta y que por lo tanto lo correcto es interés, no sin antes hacer una larga lista de intereses ya que desde luego no es lo mismo un interés público que uno privado y que éste último puede ser subjetivo o legítimo, por lo que tratando de hacer un estudio de lo “jurídicamente protegido” veremos que la conceptualización ocupa un rango inferior cuando lo verdaderamente relevante es que al margen de saber el título o denominación del derecho que consideramos nos ha sido trastocado y vulnerado. Lo importante es poder exigir su respeto, cumplimiento y en su momento resarcimiento por quien lo ha trastocado, sea o no autoridad, pero si lo es, aún con mayor razón cumpla sus funciones y haga respetar la norma.
