Reglamento de la Comisión Permanente del Tribunal Universitario de la Universidad Michoacana de San Nicolás de Hidalgo

Abstract

The University Council as the highest authority of the University, needed to achieve proper operation rely on internal organs which are called standing or special committees; within the Permanent University Tribunal which has the task of judging the university through opinions, which are ratified before the full University Council is, but this body lacks a crucial and basic factor to perform their functions: an internal regulation or legal regulation to ensure the parties to come to him, a minimum of guarantees of any process, the court can not and must suffer from a structure in which the powers of its members are specified, notification procedure university, deadlines or terms, the scope and application of sanctions, etc., but mostly can not refrain from due process. University Court is included in the Organic Law of the Universidad Michoacana de San Nicolas de Hidalgo (being the highest legal source of the university which has only intervention the Local Congress), the University Statute in which intervenes to change the highest authority within the university which is a collegial body, called the University Council, and also appears in the Rules of procedure H. University Council, but in none of the above establishes a procedure to be followed by the committee, and lack of proper and dignified for college parties to a "college judgment" process. It is a commitment of the university whether researchers, professors, university prepared, knowing the law, that we bring our own home to avoid exposing it to unnecessary setbacks. This thesis may provide an alternative to improve and strengthen the seriousness of this institution.

El Consejo Universitario como máxima autoridad de la Universidad, necesita para lograr su funcionamiento adecuado apoyarse en órganos internos a los cuales se les llama comisiones permanentes o especiales; dentro de las permanentes se encuentra el Tribunal Universitario el cual tiene la tarea de juzgar a los universitarios por medio de dictámenes, los cuales se ratifican ante el pleno del Consejo Universitario, pero este órgano carece de un factor determinante y básico para desarrollar sus funciones: un reglamento interno o bien una regulación legal que garantice a las partes que acudan a él, un mínimo de garantías de todo proceso, el tribunal no puede ni debe adolecer de una estructura en la cual se especifiquen las atribuciones de sus miembros, notificación de procedimiento universitario, plazos o términos, los alcances y aplicación de sus sanciones, etc., pero sobre todo no puede abstenerse de un proceso adecuado. El Tribunal Universitario está incluido en la Ley Orgánica de la Universidad Michoacana de San Nicolás de Hidalgo (siendo esta la fuente legal máxima de la Universidad en la cual solo tiene intervención el Congreso Local), el Estatuto Universitario en el cual interviene para su modificación la autoridad máxima al interior de la Universidad que es un órgano colegiado, el denominado Consejo Universitario, y también aparece en el Reglamento Interno del H. Consejo Universitario, pero en ninguno de los anteriores se establece un procedimiento a seguir por esta comisión, careciendo así de un proceso adecuado y digno para los universitarios que sean partes en un “juicio universitario”. Es un compromiso de los universitarios ya sean investigadores, catedráticos, universitarios preparados, conocedores del derecho, que aportemos a nuestra propia casa, para evitar exponerla a contrariedades innecesarias. La presente tesina podrá aportar una alternativa para mejorar y robustecer la seriedad de esta institución.
