La inconstitucionalidad de las reformas constitucionales en México

Abstract

The research that is presented, analyzes the issue of the Unconstitutionality of Constitutional Reforms in Mexico. It supports the possibility of issuing reforms to the Constitution that are formally unconstitutional, and the unjustified legal remedies that can be enforced to challenge such reforms. Similarly, it is argued that in systems of representative democracy such as exists in our country, it is not possible to accept constitutional reforms that are materially unconstitutional, because in the end, the content of a reform to the Supreme Law is Always the result of the exercise of sovereign power through representative democracy, which is why it is proposed to seek the transition to a participatory and determinative democracy.

La investigación que se presenta, analiza el tema de la Inconstitucionalidad de las Reformas Constitucionales en México. En ella, se sostiene la posibilidad de que se expidan reformas a la Constitución que sean formalmente inconstitucionales, y la improcedencia de recursos jurídicos que puedan hacerse valer para impugnar este tipo de reformas. De igual manera, se sostiene que en los sistemas de democracia representativa como el que existe en nuestro país, no es posible aceptar que existan reformas constitucionales que sean materialmente inconstitucionales, pues a final de cuentas, el contenido de una reforma a la Ley Suprema es siempre el resultado del ejercicio del poder soberano a través de la democracia representativa, motivo por el cual se propone buscar la transición hacia una democracia participativa y determinativa.
