La reproducción asistida en el contexto jurídico mexicano

Abstract

The present work is a research that deals with the study of assisted fertilization in the Mexican legal context, analyzing the phenomenology that is being presented in the current social reality around the use and access of assisted reproduction methods, and its implications in The field of family law. As will be observed in the same, it deals with aspects of a technical nature - such as the applicable scientific terminology -, the nature and characteristics of such a method, as well as the consequences that it generates in the field of law when through it a life . It should be taken into account that the issue of assisted fertilization has implications for such important aspects as the right to procreation (provided for in Article 4 of the Constitution), public health and parentage (given that there are only certain Rules that allude to assisted fertilization, without defining or delimiting them, much less detailing the legal treatment that should be given, when they concern the filiation).

El presente es un trabajo de investigación que aborda el estudio de la fecundación asistida en el contexto jurídico mexicano, analizando la fenomenología que se viene presentando en la realidad social actual en torno al uso y acceso de los métodos de reproducción asistida, y sus implicaciones en el campo del derecho familiar. Como podrá observarse en el mismo, se abordan aspectos de orden técnico -tales como la terminología científica aplicable-, la naturaleza y características de tal método, así como las consecuencias que genera en el campo del derecho cuando a través del mismo se engendra una vida. Es de tomarse en cuenta que el tema de la fecundación asistida tiene implicaciones en aspectos tan importantes como el derecho a la procreación (previsto en el artículo 4o Constitucional), en la salud pública y en materia de filiación (dado que sólo existen expresiones en ciertas normas que aluden a la fecundación asistida, sin definirlas o delimitarlas, y mucho menos, detallar el tratamiento jurídico que debe dárseles, cuando atañen a la filiación).
