La facultad de investigación de la Suprema Corte de Justicia de la Nación en el caso de la "Guardería ABC"

Abstract

The proper functioning of the institutions and the regime of liability on public servants are two essential elements for the state to fulfill its duties entrusted by the governed if not the detriment of the guarantees and fundamental rights of the people are in danger of being violated and there is no effective means of protection. The Supreme Court of Justice of the Nation until 2011 had a single allocation to determinate the gross violation of fundamental rights by the authorities, this draft examines the suitability of that faculty and whether its use was effective, for it is based in a specific case "ABC Nursery" in which unfortunately 49 children were death and many more injured. That is why it is considered important for the present analysis based on the conclusions to be thrown reflect on the effectiveness of the means of constitutional protection against the reality of life in the Mexican state.

El buen funcionamiento de las instituciones y el régimen de responsabilidad de los servidores públicos son dos elementos esenciales para que el Estado cumpla con sus funciones encomendadas por los gobernados, si no en detrimento de las garantías y derechos fundamentales de las personas están en riesgo de violación y hay ningún medio eficaz de protección. La Corte Suprema de Justicia de la Nación hasta 2011 tenía una única asignación para determinar la violación grave de los derechos fundamentales por parte de las autoridades, este proyecto examina la idoneidad de esa facultad y si su uso fue eficaz, ya que se basa en un caso concreto "Guardería ABC "en la que, lamentablemente, 49 niños fueron la muerte y muchos más heridos. Es por ello que se considera importante para el presente análisis sobre la base de las conclusiones que se arrojen reflexionar sobre la eficacia de los medios de protección constitucional en contra de la realidad de la vida en el estado mexicano.
