Abstract: In Michoacan (western state of Mexico), the confessional evidence would be accurately applied if the Judge had the obligation to demand explanations on all the answers by the defendant, specially those being negative ones, for there is an obvious lie and contradiction on his behaviour, and the defendant would not benefit by only answering in negative terms, knowing the Judge is forced by law to demand any explanation needed. The confessional evidence was held some time ago as the „queen of proofs‟, but today has become a mere rutine, but if there existed a correct valuation and use of this mean of proof, we would be facing a very important evidence towards truth. The confessional evidence is a very important mean of proof among the civil procedure, there exist various kinds of confessions, but the one under this study is the one used when answer interrogatories, called absolver posiciones. The confession has been analyzed from the common law, socialist and neo-roman fammilies, and they are very similar in their procedures and usefulness, as one might see in the laws of these mexican states: Sinaloa, Jalisco, Nuevo León, Guanajuato and Michoacán. The confessional evidence is regulated both in national laws, isolated law thesis and jurisprudences, and of course the local laws in Michoacán state.
En el estado de Michoacán se aplicaría correctamente la prueba confesional, si el juez tuviera la obligación de exigir explicaciones en todas las posiciones contestadas por el absolvente, sobre todo en las que conteste de forma negativa, siendo evidente la mentira y la contradicción con las que se conduce, y el absolvente ya no se beneficiaría sólo contestando en forma negativa, sabiendo que el juez tiene la obligación legislativa de exigir las explicaciones correspondientes. La prueba confesional en un tiempo fue considerada como “la reina de las pruebas”, pero hoy en día prácticamente se convirtió en un mero trámite; pero si existiera una correcta aplicación y valoración de este medio probatorio, estaríamos frente una prueba de un carácter muy importante y que nos aproximaría a la verdad. La prueba confesional es dentro del Derecho procesal civil un medio de prueba muy importante, existiendo diferentes tipos de confesión, pero la que nos ocupa es la que es hecha al absolver posiciones. La confesión; se ha analizado desde las familias del common law, socialista, neo romanista, y son muy similares en sus sistemas de procedimiento y finalidad, tal como se ve en las legislaciones de Sinaloa, Jalisco, Nuevo León, Guanajuato, y por último Michoacán. La prueba confesional se encuentra regulada en la legislación nacional como también en tesis aisladas y jurisprudencia; y legislación local en el Estado de Michoacán.
