La construcción social y crítica de los derechos humanos. Un análisis a partir del derecho a la educación

Abstract

Three years after the adoption of the constitutional reform on human rights June 2011, becomes important in the immediate context of our country, reflect the situation of human rights. Since the current regulatory paradigm, we analyze this issue from another context, ie, take a critical perspective that is move somewhat of policy and institutional version of human rights and size them from the everyday and real context of "the other, those below, those on foot ", translated in the new social movements. In that sense, this research first part of the regulatory and institutional and social dimension of human rights; secondly, we analyze the institutions actions imposed by the state to maintain the validity of such rights; finally, from the social, rephrase from the right to human rights education, and the social construction of human rights review.

A tres años de la aprobación de la reforma constitucional en materia de Derechos humanos de junio de 2011, se torna importante en el contexto inmediato de nuestro país, reflexionar la situación de los Derechos humanos. Desde ese paradigma normativo vigente, analizamos dicha temática desde otro contexto, es decir, dese una perspectiva crítica, que consiste en desplazarnos un tanto de la versión normativa e institucional de los Derechos humanos y dimensionarlos desde el contexto cotidiano y real de “los otros, los de abajo, los de a pie”, traducidos en los nuevos movimientos sociales. En ese sentido, ésta investigación, parte en primer lugar, de la dimensión normativa e institucional y social de los Derechos humanos; en segundo lugar, analizamos las acciones instituciones impuestas por el Estado para mantener la vigencia de tales Derechos; finalmente, desde la dimensión social, replanteamos a partir del Derecho a la educación en Derechos humanos, la construcción social y crítica de los Derechos humanos.
