La inconstitucionalidad de la negativa ficta

Abstract

Derived from the above, it is appropriate to consider that, in this investigation should be proved consequently the main reasoning that allows to demonstrate as such what is included in the present hypothesis, so in the section of conclusions and proposal, the result of the same.

Los ciudadanos mexicanos que requieran de información que tengan las autoridades, podrán solicitarla previa solicitud por escrito, la que será presentada ante las mismas, a efecto de contar con ella, por lo que, la autoridad tiene la obligación de responder en forma negativa o positiva, en un breve término. Al referir lo correspondiente a la respuesta que deberá de emitir la autoridad competente previa solicitud formal del ciudadano mexicano, en la presente investigación se observa desde una sola visión, la que, entre otros, permite verificar que deben de surgen a la vida jurídica los elementos de una figura como tal, es decir, que al establecer la Carta Magna lo relativo a una petición, no cita si son en una materia única de derecho, sino lo es, luego entonces el hecho generador como tal, es decir que, consecuentemente a toda petición deberá de recaer respuesta formal, que será emitida por el responsable para ello, de lo anterior emana la hipótesis real consistente en que la ficta nace de una solicitud y que no es considerable el hecho notorio de que se atribuyen por materias dos nombres diferentes para una misma esencia de resultado jurídico, toda vez que, lo positivo y lo negativo emanan del hecho generador como tal, mismos que son generados por el acto principal, por lo que, en consecuencia y por lógica jurídica es poco considerable en el campo del derecho la misma diferencia. Derivado de lo anterior, es procedente considerar que, en ésta investigación deberá de probarse consecuentemente el razonamiento principal que permita demostrar como tal lo vertido en la presente hipótesis, por ello en el apartado de conclusiones y propuesta, deberá de plasmarse el resultado de la misma.
