La inconstitucionalidad de la omisión legislativa en México, una realidad susceptible de control

Abstract

In the following essay, the author makes a critical analysis of the rationale for the figure of the unconstitutional legislative inaction in Mexico, providing arguments both for and against, as well as the possible consequences of their acceptance or rejection in the federal legal system. To do this, it has taken into account the emergence and historical development of legislative omissions, taxonomy, and the doctrine developed until today. Also the feasibility of a proposal that is considered suitable for the control of omissions alleged to legislative bodies and that violate the Constitution of the United Mexican States is analyzed.

En este ensayo la autora realiza un análisis crítico sobre la justificación de la figura de la inconstitucionalidad por omisión legislativa en México, aportando argumentos tanto a favor como en contra, así como las posibles consecuencias de su aceptación o rechazo en el ordenamiento jurídico federal. Para ello, se ha tomado en cuenta el surgimiento y desarrollo histórico de las omisiones legislativas, su taxonomía, así como la doctrina hasta en la actualidad desarrollada. Asimismo se analiza la viabilidad de una propuesta que se considera recomendable para el control de las omisiones imputadas a los cuerpos legislativos y que vulneran la Constitución Política de los Estados Unidos Mexicanos.
