Criterios de la Corte Interamericana de Derechos Humanos en relación al derecho a la consulta libre, previa e informada de los pueblos indígenas

Abstract

With the mediation of the Organization of American States (OAS), specifically the Court and the Inter-American Commission on Human Rights (IACHR), throughout this work, it shall be explained how arguments are developed in court for case studies advocating the right of indigenous peoples to be informed freely and in advance. However, to develop such a topic we will dare to uproot the key elements, which can help us understand the right to be informed, especially focusing on the relationship between the members of an indigenous people and their natural resources, as well as the very ecosystem that ensures their conservation and life expectancy. We will also study the organizational structure of the OAS, paying special attention to the attributions of the commission itself and the court. By doing the latter, we will be able to understand its makeup and the criteria they base their resolutions on. Lastly, two relevant cases that present a paradigm regarding the right to be informed by the indigenous peoples will be analyzed closely. Even if we believe firmly in the right to be informed, this issue should be studied from outside a positive system and from a critical perspective. Within the Human Rights platform, there is an initiative which the establishment tries to legalize. The characteristics of such legislative instrument can be in turn a legal resource to advocate indigenous rights. There may be a given number of other cases involving the right to be informed, but this work focuses on the court’s proceedings regarding the two specific cases mentioned here.

Con la intervención del Sistema Interamericano, específicamente la Corte y la Comisión Interamericana de los Derechos Humanos, veremos cómo se desarrollan los argumentos dentro de la Corte en casos sometidos del Derecho a la consulta previa, libre e informada de los pueblos indígenas. Sin embargo, para desarrollar dicho tema nos atreveremos a buscar cuales son los elementos esenciales para entender el derecho a la consulta, sobre todo tiene que ver con la relación de los miembros de un pueblo indígena con sus recursos naturales y ecosistema para proteger su sobrevivencia. También analizar la estructura orgánica del Sistema Interamericano, y sobre todo analizar las atribuciones de la Comisión y la Corte. Para de esta manera tratar de entender su conformación y la forma en como resolvió, por último analizar los dos casos que conforman un paradigma respecto a la consulta de los pueblos indígenas. Aunque creamos en el derecho a la consulta, trataremos de analizarlo fuera del sistema positivo y desde una perspectiva crítica, donde también juega un papel que trata de legitimar el sistema, dentro del discurso de los derechos humanos. Pero también es un arma que nos da el sistema para defender los derechos indígenas. Quizá haya varios casos más de derecho a la consulta pero aquí nos interesa saber cómo se comporta la corte respecto de estos dos casos específicamente.
