La necesidad de la suplencia en los cargos municipales de elección popular. Caso Michoacán

Abstract

The surrogate candidature it's a paradigm that hasn't been explored enough by the investigation of the electoral subject. The importance given to the substitution is minimal in front of the responsibility that relapses in it, due to, at the end of the day it's another public electoral charge that the society decides. Having the certainty of knowing a person who will have to occupy the responsibility of representing the citizenry once he or she is elected, it´s an act of respect and strength for democracy. Leave such an important decision in the hands of the parliament state, even if they’re an elected collegiate group, it's left behind the willing of the people whose resides in the civic demarcation, who has the right to choose whom will be their representatives any time, without leaving appear the stages of social uncertainty waiting the appoint of the new president after the absence of the one who left the position. In witness whereof, the present investigation has the aim of analyze and demonstrate that in Michoacán, the set-up of a substitute candidate of the mayor is fundamentally to the care of the democracy and motivate the citizenship participation. Argentina, Uruguay, Brazil have such laws in their towns, in Mexico, cities like Puebla, Guerrero and Estado de México, have shown that there is a greater confidence in electing people who will represent the citizens in the Council.

La candidatura suplente en los cargos de elección popular han sido un paradigma que pocas veces se ven explorados por los estudios de la materia electoral. La importancia que se le da a la suplencia, es mínima ante la gran responsabilidad que recae en ella, debido a que, al final del día es un cargo más de elección popular que la sociedad decide. Tener la certeza de saber quién es la persona que habrá de ocupar la responsabilidad de representar a la ciudadanía una vez que sea electo, es un acto de respeto y fortaleza para la democracia. Dejar tan importante decisión en manos del legislativo, aunque sea un órgano colegiado electo, es hacer a un lado la voluntad de la ciudadanía que habita en las demarcaciones municipales, la cual tiene el derecho de decidir quiénes son sus representantes populares en todo momento, sin dejar que aparezcan escenarios de incertidumbre social al esperar que se designe a quien habrá de ocupar la presidencia municipal ante la ausencia de la persona que dejó el cargo. Por ello, la presente investigación va dirigida a analizar y demostrar que, en Michoacán, el instaurar la candidatura suplente en la presidencia municipal, debe ser fundamental para cuidar la democracia del estado y de esta manera incentivar la participación ciudadana. En países como Argentina, Uruguay y Brasil, existe dicha figura dentro de las leyes municipales, así como en estados como Puebla, Guerrero y Estado de México, las cuales han demostrado que existe una mayor confianza para elegir a las personas que representaran en el Cabildo a la ciudadanía.
