La ética judicial como criterio rector en la función jurisdiccional

Abstract

The figure of the Mexican Judge has constantly changed to adjust to social reality; It is no longer possible to speak of a Judge who only applies the Law strictly to carry out his function. Social movements have given rise to numerous reforms in Constitutional matters, and therefore, the bastion that the Judicial Power symbolizes (in its local and federal spheres) evolves at the same time. That is why Judicial Ethics is of vital importance for the consolidation of the new Judges and that they are part of a new justice. This work symbolizes the reflection of the figure of Judicial Ethics within our Mexican legal system, counting on its advances and the principles and values that comprise it. Similarly, it refers to all those aspects that detract from the figure of Judges, with their respective responsibilities and sanctions.

La figura del Juzgador Mexicano ha cambiado constantemente para ajustarse a la realidad social; ya no se puede hablar de un Juez que únicamente aplica el Derecho estrictamente para llevar a cabo su función. Los movimientos sociales han dado pie a numerosas reformas en materia Constitucional, y por ende, el bastión que simboliza el Poder Judicial (en sus ámbitos local y federal) evoluciona al mismo tiempo. Es por ello que la Ética Judicial es de vital importancia para la consolidación de los nuevos Jueces y que estos sean parte de una nueva justicia. Este trabajo simboliza la reflexión de la figura de la Ética Judicial dentro de nuestro sistema jurídico mexicano, contando con sus avances y los principios y valores que la integran. De igual manera, hace referencia a todos aquellos aspectos que demeritan la figura de los Juzgadores, con sus respectivas responsabilidades y sanciones.
