La transparencia de la función jurisdiccional a través de la publicación de las sentencias ejecutorias

Abstract

The right of access to information in Mexico has a recent development. The Supreme Court of Justice of the Nation was defining the scope of this right and established a model of transparency through the Federal Judicial Weekly. The recent reforms to the constitutional and legal framework determine that the federal and state judiciary are obligated subjects, and must make public the executory sentences that are of public interest. In the current context, information technologies allow data to transcend time and space with the use of the internet; However, such specification is restrictive, because there are no technical or legal reasons that prevent all executions from being heard by the Judges.

El derecho de acceso a la información en México tiene un desarrollo reciente. La Suprema Corte de Justicia de la Nación fue definiendo el alcance de este derecho y estableció un modelo de transparencia a través del Semanario Judicial de la Federación. Las recientes reformas al marco constitucional y legal determinan que el Poder Judicial federal y estatal son sujetos obligados, y deben hacer públicas las sentencias ejecutorias que sean de interés público. En el contexto actual, las tecnologías de la información permiten que los datos trasciendan en el tiempo y el espacio con el uso del internet; sin embargo tal especificación es restrictiva, pues no hay razones ni técnicas, ni legales que impidan conocer la totalidad de las sentencias ejecutorias emiten los Juzgadores.
