Derecho a un medio ambiente sano y los derechos humanos: Acuerdo de Escazú y su carácter vinculante para una mejor protección ambiental en el estado de Michoacán

Abstract

At present, the environmental problem has stood out and is a latent concern for humanity in all sectors, professions and our experiences in daily life when we find ourselves with a critical situation when it comes to the environment, for this reason, environmental law arises that we consider in this research as a science or branch of law that tends to stop the negative impacts caused by human actions, contributing to a healthy environment as a human right. Thus, in some way, although we have institutions that protect the environment, including institutions that protect our human rights, we continue with a crisis that as researchers from the legal and human rights perspective, we are not complying with its effective protection and it is our responsibility. must find these deficiencies or the way to improve the legal and institutional protection of the human right to a healthy environment. The Mexican Constitution stipulates this human right, national and international jurisprudence, infuses the right to a healthy environment as fundamental and basic, this happens clearly, through its protection and gives us elements to consider a better opportunity to grant it the hierarchy and importance that it deserves and grant an ideal protection to the needs of our country and of course, of the State of Michoacán. If we assume the existence of environmental protection with all the legal protection it deserves, the responsibility to execute is to establish its scope and hierarchical position. In our state, the tools available to guarantee this human right are inefficient and we are faced with new challenges, however, in the search for new binding guarantors within the framework of the recent Escazú agreement, it provides us with a new area of opportunity that grants each state for better protection of the human right to a healthy environment.

En la actualidad, la problemática ambiental ha destacado y es una latente preocupación para la humanidad en todos los sectores, profesiones y nuestras experiencias en la vida cotidiana cuando nos encontramos con alguna situación crítica tratándose del medio ambiente, por tal motivo, surge el derecho ambiental que contemplamos en esta investigación como una ciencia o rama del derecho que tiende a detener los impactos negativos que causa el actuar del ser humano, contribuyendo con el medio ambiente sano como un derecho humano. Es así que, de alguna manera, aunque tengamos instituciones protectoras del medio ambiente, incluyendo instituciones protectoras de nuestros derechos humanos, continuamos con una crisis que como investigadores desde la óptica jurídica y de derechos humanos, no estamos cumpliendo con su efectiva protección y es nuestro deber encontrar esas deficiencias o la manera de mejorar la protección jurídica e institucional del derecho humano a un medio ambiente sano. La Constitución Mexicana estipula este derecho humano y nos da elementos para considerar una mejor oportunidad para otorgarle la jerarquía e importancia que amerita y otorgar una protección idónea a las necesidades de nuestro país y por supuesto, del Estado de Michoacán. Si asumimos la existencia de una protección ambiental con toda la protección jurídica merecida, la responsabilidad por ejecutar es establecer su alcance y posición jerárquica. En nuestro estado, las herramientas al alcance para la garantizar este derecho humano son ineficientes y nos encontrándonos con nuevos retos, sin embargo, en la búsqueda de nuevos garantes vinculantes en marco del reciente acuerdo de Escazú, nos proporciona una nueva área de oportunidad que otorga cada estado para una mejor protección del derecho humano a un medio ambiente sano.
