Resumen : The right to property is regulated within our maximum norm, which is the Constitution in its article 27, from this right derives the right to succession, that is, to all people who have property, the law grants them the power to be able to allocate them through succession to the heirs designated by them. The foregoing is applicable in the same way in agrarian matters, although it is true that the ejidatarios have the right to appoint their successor by means of the agrarian will, it is also true that the same law of the matter does not allow them to appoint more than an heir, and it is there where it greatly limits the will that the individual has over his plots that belong to the property of the ejidatario, not losing sight of the fact that such plots belong to the social regime in the country, which is governed by Agrarian Law. In this situation, the present investigation intends to demonstrate that the fact that the Agrarian Law does not allow the ejidatario to leave more than one successor for the rights of the plots that they may have, implies a violation of the human right of property.
El derecho a la propiedad se encuentra regulado dentro de nuestra máxima norma que es la Constitución en su artículo 27, de este derecho se deriva el derecho a la sucesión, es decir, a todas las personas que tienen propiedades la ley les otorga la facultad de poder destinarlas por medio de la sucesión a los herederos designados por las mismas. Lo anterior es aplicable de la misma forma en la materia agraria, si bien es cierto los ejidatarios tienen el derecho de nombrar a su sucesor por medio del testamento agrario, también lo es que la misma ley de la materia no les permite el nombrar más que un heredero, y es ahí donde limita enormemente la voluntad que tiene el individuo sobre sus parcelas que pertenecen a la propiedad del ejidatario, no perdiendo de vista que tales parcelas son del régimen social en el país , el cual es regido mediante el Derecho Agrario. En esta tesitura, la presente investigación pretende demostrar que el hecho que la Ley Agraria no permita al ejidatario dejar a más de un sucesor para los derechos de las parcelas que pudieran tener, implica una violación al derecho humano de propiedad.
