Propuesta para celebrar el matrimonio ante notario público del estado de Michoacán de Ocampo

Abstract

The aim of this research is to find an answer about the possibility that a public notary could perform a wedding in the State of Michoacán, as well as the Civil Registry Officer do; this is related to the fact that in the current law the public notary do perform the divorce. This research analyzes the historical background of marriage, its legal nature, as well the background and functions of the Civil Registry; it also examines the notarial institution, its legal nature, its activities, faculties and responsibility, which leads us to determine that the professional profile and attributes of a public notary could contribute to perform weddings, as they do nowadays performing divorces. Derived from the findings of this investigation, it is possible to propose additions to the Michoacán State Law of Notaries, that empowers the Notary to perform weddings. This research is based on a mixed methodological strategy, since office work was carried out for the documents analysis; a survey was applied to find out the opinion of a sector of the citizenry regarding the possibility that the marriage could be celebrated by a public notary and an interview was conducted with the President of the National Association of Mexican Notaries.

El objetivo de esta investigación es encontrar respuesta a la reflexión acerca de la facultad para celebrar matrimonios, por parte del notario público del Estado de Michoacán, en forma concurrente, con el Oficial del Registro Civil; en virtud de que en la actualidad el notario puede celebrar el divorcio notarial. Se analiza la naturaleza jurídica del matrimonio y algunos aspectos históricos; así como antecedentes y funciones del Registro Civil; se examina la institución notarial, la naturaleza jurídica, actividades, facultades y responsabilidades de los notarios. Lo que nos lleva a determinar que su preparación profesional y atributos pueden coadyuvar para celebrar matrimonios a la par que lo hace en materia de divorcios. Esto nos permite proponer un proyecto de adiciones a la Ley del Notariado que faculten al Notario para celebrar el matrimonio. Esta investigación se basa en una estrategia metodológica mixta, pues se realizó trabajo de gabinete para el análisis documental; se aplicó una encuesta para conocer la opinión de un sector de la ciudadanía respecto a la posibilidad de que el matrimonio pueda ser celebrado por el notario público y se realizó una entrevista al Presidente del Colegio Nacional del Notariado Mexicano.
