Valoración de la efectividad del recurso de reconsideración dentro del Tribunal de Justicia Administrativa de Michoacán de Ocampo

Abstract

The Administrative Law, is a branch of the public law that rules the activities and administrative functions of the State carried out by its different authorities, through the surveillance and control of the material acts that it is a part of the administrative function producing legal consequences. The Court of Administrative Justice in the State of Michoacán, is an autonomous organism that regulates the legality of the material acts of the public administration, as well as the administrative proceedings between the private citizens and the different offices of the government like the public decentralized organisms of State and Municipal level. In the administrative contentious proceeding, subsequent to its phase of proceeding and instruction a study in-depth of the issue is done, remaining the writs in a state of resolution, once the project has been approved by an Examining Judge will be submitted to voting by the judges who are members of the collegiate courtroom of the aforementioned judicial body. After the notice of resolution of the administrative trial, the parties have three working days to file an appeal of reconsideration being this appeal proceeding used against the agreements or resolutions that caused the tort, it is filed before the collegiate courtroom and it is delivered to a judge other than the examining judge, nevertheless the project of resolution that was filed will be known and voted again by the same judge that committed the refuted act of the appeal proceeding. Being the appeal of reconsideration analyzed and voted by the same collegiate courtroom and the same judge who is being appealed, an agreement or resolution does not bring with itself favorable results to the parties that filed an appeal proceeding.

El derecho administrativo, es una rama del derecho público, que se encarga de regir las actividades y funciones administrativas del Estado realizadas por sus distintas autoridades, por medio de la vigilancia y el control de los actos materiales que forma parte de la función administrativa produciendo consecuencias jurídicas. El Tribunal de Justicia Administrativa del Estado de Michoacán, es un organismo autónomo que se encarga de regular la legalidad de los actos de la administración pública, así como de los procedimientos administrativos entre los particulares y las diferentes dependencias de gobierno como los organismos públicos desconcentrados a nivel Municipal y Estatal. En el proceso contencioso administrativo, posterior a su etapa de trámite e instrucción se procede a realizar el estudio de fondo del asunto, quedando los autos en estado de resolución, una vez aprobado el proyecto por el magistrado instructor será sometido a votación por los magistrados integrantes de la sala colegiada de dicho órgano jurisdiccional. Después de la notificación de resolución del juicio administrativo, las partes tienen tres días hábiles para interponer el recurso de reconsideración siendo este el medio de impugnación utilizado en contra de los acuerdos o resoluciones que les causan agravio, se presenta ante la sala colegiada y se turna a un magistrado distinto al instructor, sin embargo el proyecto de resolución que se presentó será conocido y votado de nuevo por el magistrado que cometió el acto refutado del medio de impugnación. Al ser el recurso de reconsideración analizado y votado por la misma sala colegiada y el propio magistrado al que se pretende impugnar un acuerdo o resolución no trae consigo resultados favorables para las partes que interpusieron el medio de impugnación.
