El problema de la deshumanización de las instituciones estatales en el proceso de adopción de niños en Michoacán

Abstract

In family law, a lot of issues are handled, which without exception are important for the core to which "family" refers, however one of the most complex issues about minors is Adoption, the whole process to follow, to the importance of this legal tool, which aims to integrate children whose for various reasons have been deprived of their right to be an integral part of a family that gives them a healthy physical, social, psychological and intellectual development. However, for that figure is carried out there are various institutions that could assist each other, on the understanding that each one handles specific points about a minor situation, but all of these have as primary aim to assert "the best interests of the child" any other interest of both the applicant families of adoption and of the same institutions involved therein. Once of the determining factors of the situation of our children in vulnerable situations change, it is the fact that the State take as priority the respect and full enforcement with the various laws and / or treaties concerning human rights of minors , because it is useless if you do not create laws will be implemented for the benefit of many infants are affected in their family situation, it is also crucial to note that the company plays an important role in the issue at hand, and is who can provides the care, attention and make that child be a human being as well.

Dentro del derecho de familia, se manejan un sinfín de temas, los cuales todos sin excepción son importantes por el núcleo al cual se refieren “la familia”, sin embargo uno de los temas más complejos y que en cuanto a menores se refiere es el relativo a la Adopción, a todo el proceso a seguir, a la importancia de esta herramienta jurídica, cuyo objetivo es el de integrar un menor que por diversas causas se ha visto privado de su derecho a ser parte integrante de una familia que le brinde un sano desarrollo físico, social, psicológico e intelectual. Sin embargo, para que esta figura se lleve a cabo son diversas las Instituciones que deben de coadyuvar entre sí, bajo el entendido que cada una de ellas maneja situaciones específicas en cuanto a la situación de un menor, sin embargo todas tienen como fin primordial hacer valer “el interés superior del menor” sobre cualquier otro interés, tanto de las familias solicitantes de adopción como de las mismas instituciones que en ella intervienen. Uno de los factores determinantes para que la situación de nuestros menores en estado de vulnerabilidad cambie, es el hecho de que el Estado tome como prioridad el respeto y el cabal cumplimiento de las diversas legislaciones y/o tratados referentes a los derechos humanos de los menores, porque de nada sirve crear leyes si no se pondrán en práctica en beneficio de los tantos infantes que se ven afectados en su situación familiar, asimismo es fundamental señalar el hecho de que la sociedad juega un papel importante en el tema que nos ocupa, ya que es está quien puede brindar los cuidados, las atenciones y hacer de ese menor un ser humano de bien.
