La desigualdad del derecho a la salud en México

Abstract

The issue is tackled as health law such as right to health protection, to understand the health system in Mexico and institutes guarantors for excelent of this right, it stands out IMSS, ISSSTE, PEMEX, SSA, SEMAR and SEDENA, parallel to them, they are private institutions such as aimed a the general population. Stands out the popular health services and the IMSS-Oportunity program to detect the juridical problem to by inequal Access and coverage on the subject. In addition to this, the Spanish health system, which has a universal character and its health system is public, the legislation is through the General Health Law is investigated, in addition to join the European Union set medical tourism, which is approved by the Minister of health. The study begins with a conceptual framework, also, the historical development of the right to health is studied, focusing national and internationally with the most important events in the field of health, the right to health in the country is also analyzed in Spain, to mention the way the health system is integrated on a national basis and through their regions. Moreover, a reflection of inequality in access to health through the legal system, analyzing roughly the General Law of Health in Mexico is done.

Se aborda el tema del derecho a la salud y el derecho a la protección de la salud, para entender el sistema de salud en México y los institutos garantes por excelencia de tal derecho, destacándose el IMSS, ISSSTE, PEMEX, SSA, SEMAR y SEDENA, paralelo a ellos, se encuentran las instituciones privadas y las dirigidas a la población abierta, destacando el Seguro Popular de Salud, la Secretaría de Salud, Servicios Estatales de Salud y el Programa IMSS-Oportunidades, al detectar la problemática jurídica de la salud, mediante la desigualdad en el acceso y cobertura en la materia. Aunado a lo anterior, se investiga el sistema de salud español, el cual tiene un carácter universal y su sistema de salud es público, destaca la Ley General de Sanidad dentro de su legislación en materia de salud, además al formar parte de la Unión Europea, se establece el turismo sanitario, que es aprobado por el Ministro de Sanidad. El estudio inicia con un marco conceptual, así mismo, se estudia el devenir histórico del derecho a la salud, enfocándose de forma nacional e internacional con los acontecimientos más relevantes en materia de salud, también, se analiza el derecho a la salud en el país de España, al hacer mención de la forma en la que se integra el sistema de salud de manera nacional y mediante sus comunidades autónomas. Por otra parte, se hace una reflexión de la desigualdad en el acceso de la salud mediante el régimen jurídico, analizando a groso modo la Ley General de Salud en México.
