Abstract: The idea of anti-disciplinary right in Michel Foucault’s thought can be found as a marginal issue in his studies about subject, and power relations. In transition from disciplinary societies to control societies, the French philosopher starts a different way of thinking law without appealing to the idea of sovereignty, leaving behind some recurring misconceptions that have been present in the story of thought. This issue has been ignored by both philosophers and jurists, and it can only be comprehended as a part of a new political philosophy.
La idea del derecho anti disciplinario en el pensamiento de Michel Foucault se localiza como un tema periférico en sus estudios sobre el sujeto y las relaciones de poder, en el paso de la sociedad disciplinaria a la sociedad de control el filósofo francés inaugura una forma distinta de pensar el derecho sin necesidad de recurrir a la idea de la soberanía, dejando tras de sí varios equívocos que se vienen registrando en la historia del pensamiento. Se trata de un tema que ha pasado desapercibido tanto para filósofos como para juristas y sólo se puede concebir dentro de una nueva filosofía política.
