La aplicabilidad del control difuso de convencionalidad en México

Abstract

Diffuse control of conventionality is the guarantee of human rights at the domestic international source. Mexico recognized in 2011 that all authorities are obliged and empowered to promote, respect, protect and guarantee the human rights contained in both the federal Constitution and international treaties the Mexican state is part of, five years after such recognition, this paper seeks to understand the practical operation of the said guarantee.

El control difuso de convencionalidad es la garantía de los derechos humanos de fuente internacional en sede interna. México reconoció en 2011 que todas las autoridades están obligadas y facultadas para promover, respetar, proteger y garantizar los derechos humanos contenidos tanto en la Constitución federal como en los tratados internacionales de los que el estado mexicano sea parte, cinco años después de tal reconocimiento, este trabajo busca conocer el funcionamiento práctico de dicha garantía.
