La inexistencia de la libertad municipal como garantía institucional en el México del siglo XXI (2016)

Abstract

This research work adresses the issue of the lack municipal freedom, as institutional guarantee in the XXI century in Mexico, which was planted from a historical and legal view, the purpose to investigate the genealogy of the Municipality, its structure, its elements, the functions of plays, as an indispensable to appraising the dimensions and its scope of the constitutional formula referred to in article 115 of the Constitution of the United Mexican States. So we can to uderstand the social-legal reality of the first level of government in our federalist system, it was considered essential to make an analysis and study of the Municipality as public organism of government, politic and administrative unit and descentralization tool of public functions in the Mexico of the XXI century. Finally it makes an annalysis of the municipal typology from a group of indicators—demographic, economic, educational and Health—,that they offer a very specific endogenous view of the prevailing conditions in the 2,446 municipalities in the all national territory, they have the propouse to show us the difference between legal and social reality, and eventually demonstrate the degree of impact that the absence of municipal freedom originates in Mexico.

El presente trabajo de investigación aborda el tema de inexistencia de la libertad municipal como garantía institucional en el México del siglo XXI, el cual se plantea desde una visión histórica y jurídica, con el propósito de indagar la genealogía del municipio, su estructura, sus elementos, las funciones que desempeña, como un requisito indispensable para justipreciar las dimensiones y alcances de la fórmula constitucional contemplada en el artículo 115 de la Constitución Política de los Estados Unidos Mexicanos. Para poder entender la realidad jurídico-social del primer nivel de gobierno en nuestro sistema federalista, se consideró indispensable realizar un análisis y estudio del Municipio, en cuanto ente público de gobierno, unidad política y administrativa, así como herramienta descentralizadora de las funciones públicas en el México del siglo XXI. Finalmente, se realiza una análisis de la tipología municipal a partir de un conjunto de indicadores -demográficos, económicos, educativos y de salud-, que ofrecen una visión endógena muy puntual de las condiciones imperantes en los 2446 dos mil cuatrocientos cuarenta y seis Municipios que conforman la geografía nacional, esto con el propósito de dimensionar la diferencia existente entre la realidad jurídica y la social, y eventualmente evidenciar el grado de incidencia que la inexistencia de la libertad municipal actualmente origina en México.
