El nuevo constitucionalismo latinoamericano y el procedimiento de reforma constitucional en México

Abstract

This Dissertation focuses on the issues that come with the fact that only the constituted powers take part in Constitutional Reform procedures in Mexico. It uses the theoretical perspective of the New Latin American Constitutionalism, which claims the concept of democratic constituent power and its necessary intervention in the creation and modification of the constitutional text. It also establishes the limits and the necessary legitimacy in the process of constitutional reforms. Establishing the possibility that the people participate in the referred procedure through the constitutional referendum.

Este trabajo de investigaciónn plantea la problemática que genera el que solo los poderes constituidos participen en el procedimiento de reforma constitucional en México. Se analiza desde la teoría del nuevo constitucionalismo latinoamericano que reivindica el concepto de poder constituyente democrático y su necesaria intervención en la creación y modificación del texto constitucional. Asimismo, se plantea que este procedimiento de reforma constitucional cuente con límites y legitimidad, estableciendo la posibilidad de que el pueblo participe en el referido procedimiento a través del referéndum constitucional.
