La participación política de las mujeres indígenas de Cherán Michoacán

Abstract

In this thesis, structured in four chapters, the participation of indigenous women in the community of Cherán Michoacán will be analyzed, starting in a general way from the historical presence of the indigenous people at the time of the conquest and the hard journey they have undergone in the recognition of their rights, pointing out the most representative authors in this topic. In addition, the ineffectiveness of the legal equality that was addressed in the constitution was discussed at the beginning, where beyond ensuring the rights of indigenous people, they were further violated. Taking into account an unavoidable issue in the legal field as was the constitutional reform in the field of human rights made in 2011 addressing the two ways of protection of human rights: jurisdictional and non-jurisdictional in order to analyze judgments of the highest court in electoral matters as it is the Electoral Court of the Judicial Power of the Federation in safeguarding the electoral political rights of indigenous women, conceived as human rights. Finally, the specific case of the indigenous community of Cherán is addressed, where the characteristics of the place, the way of its organization, inhabitants and a section containing field work are detailed by conducting surveys of women from the Cherán community. to obtain direct information on the way in which they are involved in the public affairs of their community, section that was very useful for this research work.

En la presente tesis estructurada en cuatro capítulos se analizará la participación de las mujeres indígenas en la comunidad de Cherán Michoacán partiendo de manera general de la presencia histórica de los indígenas en el momento de la conquista y el duro transitar que éstos han sufrido en el reconocimiento de sus derechos, señalando los autores más representativos en este tema. Además, se analizará la ineficacia de la igualdad jurídica que en los inicios se abordó en la constitución, donde más allá de velar por salvaguardar derechos de los indígenas se les vulneraba con ello aún más. Tomando en cuenta un tema insoslayable en el campo jurídico como fue la reforma constitucional en materia de derechos humanos realizada en el 2011 atendiendo las dos vías de protección de derechos humanos: jurisdiccional y no jurisdiccional a efecto de analizar sentencias del máximo tribunal en materia electoral como es el Tribunal Electoral del Poder Judicial de la Federación en la salvaguarda de los derechos políticos electorales de las mujeres indígenas, concebidos estos como derechos humanos. Finalmente se aborda el caso específico de la comunidad indígena de Cherán, donde se detallan las características propias del lugar, la manera de su organización, habitantes y un apartado que contiene trabajo de campo mediante la realización de encuestas a mujeres de la comunidad de Cherán, para obtener información directa de la manera en que se involucran en los asuntos públicos de su comunidad, apartado que fue muy retroalimentador para el presente trabajo de investigación.
