La responsabilidad ambiental de los servidores públicos, estudio comparado México-España

Abstract

In this paper, the paper deals with the investigation of environmental responsibility of bureaucrats, considering the basic terms, such as the definition of responsibility, types of responsibility, determining who is the bureaucrat, what are their functions and how can prevent damage environmental. This research analyzes different factors that integrate the responsibility for environmental damage and the role of the bureaucrat in this circumstance. It also considers the historical development of environmental protection and environmental responsibility through international treaties. As well as it contemplates a study on the bureaucrat and its responsibility in environmental matter in the Spanish legal system, contemplating from the Spanish Constitution until works of theoretical character.

El presente trabajo aborda la investigación de la responsabilidad en materia ambiental de los servidores públicos, contemplando los términos básicos, como son la definición de responsabilidad, los tipos de responsabilidad, determinando quien es el servidor público, cuáles son sus funciones y como puede prevenir el daño ambiental. Esta investigación analiza distintos factores que integran a la responsabilidad por daño ambiental y el papel que tiene en esta circunstancia el servidor público, además contempla el desarrollo histórico de la protección al medio ambiente y la responsabilidad en materia ambiental a través de tratados internacionales. Así como también contempla un estudio acerca del servidor público y su responsabilidad en materia ambiental en el derecho español, contemplando desde la Constitución Española hasta obras de carácter teórico jurídico.
