Las instituciones e instrumentos universales en la defensa de los derechos humanos

Abstract

The purpose of this research work is to show at least two different systems for the protection of human rights and their particularities; the inter-American system, its evolution and its future, and the European system with the same parameters. This will allow us to be in a position not only to approach the subject from a comparative point of view, but also taking into account its own peculiarities. During the investigation of this thesis, very important discoveries have emerged for me, such as the importance of international jurisprudence, its reception, but fundamentally its interpretation. This point is most noteworthy, since human rights largely owe their nature and therefore their future to international law. That is what is found in this work.

El presente trabajo de investigación tiene como propósito mostrar al menos dos sistemas distintos de protección de derechos humanos y sus particularidades; el sistema interamericano, su devenir y su futuro, y el sistema europeo con los mismos parámetros. Esto nos permitirá estar en condiciones no solo de abordar el tema desde un punto de vista comparado, sino atendiendo a sus propias particularidades. Durante la investigación de esta tesis han surgido descubrimientos para mi muy importantes, tales como la importancia de la jurisprudencia internacional, su recepción, pero fundamentalmente su interpretación. Este punto es de lo mas destacable, puesto que los derechos humanos en mucho deben al derecho internacional su naturaleza y por tanto su devenir. Eso es lo que se encuentra en el presente trabajo.
