Abstract: It is an undeniable fact that some social groups demonstrate a greater ability than others to innovate, yet the creative spirit is palpable in every culture, whether to a greater or lesser extent. Knowledge and all its manifestations are valuable, particularly if the information is inherent in a traditional system of knowledge of indigenous communities, developed as a result of the continuous and constant interaction with the complex ecosystem in which they inhabit. Knowledge that has been the main source of survival of these communities, especially in the food and health sector. As developing countries are the largest repositories of most of the world's biological resources, it is not surprising that they are seeking to innovate, conserve and protect their ecosystem and the knowledge that local people have developed around it. The present investigation intends, in principle, to analyze the scope and the compliance that the Mexican State has given to its obligation to protect the medicine developed by the Mexican indigenous groups in the light of the current system of intellectual property and of the subjective rights created by the Amendment to Article 2 of the Constitution. It begins with an analysis of the social background of indigenous peoples and communities in Mexico in the first chapter, culminating with the armed movement of the Zapatista National Liberation Army and the comprehensive reform of Article 2o Constitutional to incorporate the social rights of these groups Vulnerable. The second chapter examines the legal system in force in Mexico, where the current situation of indigenous traditional medicine and its protection in the Mexican legal system, including the Intellectual Property system, The mechanism idído for its protection, without making any pronouncement on its effectiveness or transcendence.
Es un hecho innegable que algunos grupos sociales demuestran una mayor habilidad que otros para innovar, sin embargo, el espíritu creador es palpable en cada cultura, ya sea en mayor o menor medida. El conocimiento y todas sus manifestaciones son valiosos, particularmente si la información es inherente a un sistema tradicional de conocimiento de comunidades indígenas, desarrollado como resultado de la continua y constante interacción con el complejo ecosistema en que habitan. Conocimiento que ha sido la fuente principal de supervivencia de estas comunidades, especialmente en el sector de comida y salud. Al ser los países en vías de desarrollo los mayores depositarios de la mayor parte de los recursos biológicos mundiales, no es sorprendente que estén buscando innovar, conservar y proteger su ecosistema y el conocimiento que los pueblos locales han desarrollado alrededor de éste. La presente investigación pretende, en principio, analizar los alcances y el cumplimiento que el Estado Mexicano ha dado a su obligación de proteger la medicina desarrollada por los grupos indígenas mexicanos a la luz del sistema actual de propiedad intelectual y de los derechos subjetivos creados por la reforma al artículo 2° Constitucional. Se parte de un análisis sobre los antecedentes sociales de los pueblos y comunidades indígenas en México en el capítulo primero, que culmina con el movimiento armado del Ejército Zapatista de Liberación Nacional y la reforma integral al artículo 2o Constitucional para incorporar los derechos sociales de estos grupos vulnerables. En el capítulo segundo se estudia el sistema jurídico vigente en México, donde se expone de manera clara y precisa la situación actual de la medicina tradicional indígena y su protección en el orden jurídico mexicano, incluyendo al sistema de Propiedad Intelectual, que en principio pudiera ser el mecanismo idóneo para su protección, sin hacer pronunciamiento alguno sobre su eficacia o trascendencia.
