El desafío de la corresponsabilidad social, ante el nuevo paradigma constitucional del derecho humano a la educación de calidad en México

Abstract

A study of the legal design that regulates the new constitutional paradigm of the human right to quality education in Mexico is performed in this thesis. In it, the importance that acquires the function of society in the protection of the human right to quality education is assessed, and it is shown that this design has not favored a wide social participation in the protection of this human right. Thus, an analysis of the recent constitutional reform in educational matter in Mexico and the relevance that for Mexican state means to establish a quality education indicator in the Political Constitution of the Estados Unidos Mexicanos is performed; in addition, the challenges that for the state implicate the effective application of this paradigm is also presented. In this context, one of the variables that results relevant for such legitimacy is propound, as the subject of social participation in education within the current legal design, which from the perspective of this research is limited, since educational quality not only requires social participation as it has been conceived and designed in recent years, but it also must transit to a new paradigm of social co-responsibility that protects this human right in benefit of the person’s education, beyond the school setting. The latter implicates a new interpretation of the Mexican state in the matter of the social function in education, which would have impact not only a new legal frame that regulates it, but also the public policies in the matter, which means a challenge to solve by the Mexican state.

En la presente tesis, se hace un estudio del diseño jurídico que regula el nuevo paradigma constitucional del derecho humano a la educación de calidad en México. En ella se valora la importancia que adquiere la función de la sociedad en la protección del derecho humano a la educación de calidad, y muestra que este diseño no ha favorecido una amplia participación social en la protección de este derecho humano. Para el efecto se hace un análisis de la reciente reforma constitucional en materia educativa en México y la relevancia que para el estado mexicano significa establecer en la Constitución Política de los Estados Unidos Mexicanos, el indicador de educación con calidad, asimismo, se plantean los retos que presenta para el estado la efectiva aplicación de este nuevo paradigma. En este contexto, se aborda una de las variables que resultan relevantes para dicha efectivación, como lo es el tema de la participación social en la educación dentro del diseño jurídico actual, el cual desde la perspectiva de esta investigación es limitado, ya que la calidad educativa no solo requiere de la participación social como se ha venido concibiendo y diseñando en los años recientes, sino, que debe transitar a un nuevo paradigma de corresponsabilidad social que proteja este derecho humano en beneficio de la educación de la persona, más allá del ámbito escolar. Lo anterior implica una nueva interpretación del estado mexicano en materia de la función social en la educación, mismo que impactaría no solo un nuevo diseño del marco jurídico que lo regula, sino también las políticas públicas en la materia, lo que significa un desafío por resolver en el estado mexicano.
