Las tecnologías de la información en el sistema jurídico mexicano

Abstract

It is evident that we live in a world conditioned by technology, which makes it difficult for us to conceive a life without the resources that it provides, but technology has radically transformed our social environment, in all its aspects, from the way we relate to another human being, to the way we live our "loneliness", how we work, how we think, and how we exercise our rights to transform our values and, therefore, the world around us. This is the case of the present investigation, where an analysis is made around the use of the technologies in the Mexican Legal System, not before making a small historical trip around technology, science, the Information Society, the age of technology, our legal tradition and the implementation of the Morelos System to the delivery of justice in the Michoacán Society. Thus, the hypothesis that we manage is that despite having access to the multiple benefits of scientific and technological progress, the Mexican Legal System has not been able to effectively apply it in all sectors of justice. I do not deny that at the highest levels it is done, what I argue is that not all citizens have access to them - or the economic resources to do so - so attention should be paid to the fact that the Small Courts provide better service and impartion of justice as marked by the law: prompt and expeditious and attached to the right, and not just right as we accustomed, for not having access to knowledge and what is being done in other countries, because knowledge makes us free and Ignorance stops us.

Es evidente que vivimos en un mundo condicionado por la tecnología, lo que hace difícil que concibamos la vida sin los recursos que ésta nos proporciona, sin embargo, la tecnología ha trastocado radicalmente nuestro entorno social, en todos sus aspectos, desde la manera como nos relacionamos con otro ser humano, hasta la manera como vivimos nuestra “soledad”, el cómo trabajamos, el cómo pensamos, y cómo ejercemos nuestros derechos al transformar nuestros valores y, con ello, el mundo que nos rodea. Es el caso de la presente investigación, donde se hace un análisis en torno al uso de las tecnologías en el Sistema Jurídico Mexicano, no sin antes realizar un pequeño viaje histórico en torno a la tecnología, la ciencia, la Sociedad de la Información, la era de la tecnología, nuestra tradición jurídica y la implementación del Sistema Morelos a la impartición de justicia en la Sociedad Michoacana. Así, la hipótesis que manejamos es que a pesar de tener acceso a los múltiples beneficios del avance científico y tecnológico, el Sistema Jurídico Mexicano no ha logrado aplicarlo de manera efectiva en todos los sectores de impartición de justicia. No niego que en las altas esferas se hace, lo que argumento es que no todos los ciudadanos tenemos acceso a ellas —o el recurso económico para hacerlo—, por lo que debería ponerse atención a que desde los Juzgados Menores se diera un mejor servicio y una impartición de justicia como lo marca la ley: pronta y expedita y apegada a lo justo, y no solo a derecho como acostumbramos, por no tener acceso al conocimiento y a lo que en otros países se está haciendo, pues el conocimiento nos hace libres y la ignorancia nos detiene.
