Hermenéutica jurídica desde la metafísica de Xavier Zubiri y el pensamiento iberoamericano de los derechos humanos

La hermenéutica jurídica entendida como el sentido que tiene el derecho, es la base para el sistema jurídico y sus repercusiones en la realidad, actualmente se tiene un origen hegemónico iniciado en Grecia y uno contra-hegemónico iniciado con el método de Friedrich Schleiermacher, este ha pasado por varios giros, todos ellos de autores alemanes, el primero que se puede considerar es la hermenéutica del lenguaje Wilhelm Dilthey, el segundo, es el existencialismo de Martin Heidegger, para pasar así al actual giro hermenéutico que influye actualmente la ciencia jurídica de Europa y América, el giro de comunidad-dialógica argumentativa, con autores como Jurgen Habermas, George Gadamer y Karl-Otto Apel. Pero existe la posibilidad de un giro hacia la trascendentalidad de lo real, a esta se acercó el tercer y último Karl-Otto Apel con su libro Paradigmas de la filosofía primera, pero nadie como Xavier Zubiri en los años 60´s y de 1980-1983, con su metafísica madura, donde planteó al inteligir humano como realidad respectiva entre otras realidades que son suyas de sí, la teoría del autor español, es capaz de dar otro sentido, por ello, hermenéutica jurídica alternativa, que propicie un derecho más cercano a lo real (o la trascendentalidad). Este posible giro hermenéutico, ha influido la filosofía para la liberación que a su vez desde sus diversas vertientes, son base filosófica para la filosofía iberoamericana, está formada a partir del 1492 y el encuentro de dos culturas, a partir específicamente de Bartolomé de las Casas y su uso alternativo del derecho, la hermenéutica jurídica iberoamericana, se formó a partir de la hermenéutica jurídica hispanoamericana y la latinoamericana, quedando pendiente como estudio futuro la hermenéutica jurídica pre-americana, para estar en posibilidades de proponer una hermenéutica jurídica para la región.
