El cambio de uso de suelo como afectación al derecho humano a un medio ambiente sano. Estudio de caso subcuenca del río Chiquito

Abstract

The present research work has been focused on the study and analysis of the human right to a healthy environment, focusing on the land use change of the southern zone of Morelia, and the sub-basin of the "Río Chiquito", as well as the responsibility of the municipal authorities in the granting of construction licenses and with it, in the violation of said right, protected, not only by the local regulations, but by a baggage of international instruments, in light of which, the obligation of the authorities for the safeguard of the same is configured; the previous, through a set of bibliographic studies, and a case study that has allowed to understand the current reality that predominates not only in Morelia, but in the rest of Mexico; a reality, in which corruption and economic goods are always more important than the welfare of the population and the environment in general.

El presente trabajo de investigación, ha sido enfocado en el estudio y análisis del derecho humano a un medio ambiente sano, centrándose en el cambio del uso de suelo de la zona sur de Morelia, y la sub-cuenca del “Río Chiquito”, así como la responsabilidad de las autoridades municipales en el otorgamiento de las licencias de construcción y con ello, en la vulneración de dicho derecho, tutelado, no sólo por la normatividad local, sino por un bagaje de instrumentos internacionales, a la luz de los cuales, se configura la obligación de las autoridades por la salvaguarda del mismo; lo anterior, a través de un conjunto de estudios bibliográficos, y de estudio de caso que ha permitido comprender la realidad actual que prepondera no sólo en Morelia, sino en el resto de México; una realidad, en la que la corrupción y los bienes económicos, resultan siempre más importantes que el bienestar de la población y del medio ambiente en general.
