Protección y acceso a la salud como derecho humano

Abstract

Since the paradigmatic constitutional change of Human Rights in 2011, the normative provisions in the matter acquired a different connotation of protection when establishing a new legal sphere for people under the protection of international instruments. Under this progressive legal order, it is possible to speak about the right to health to guarantee access in the material field. Being an economic, social and cultural right, the right to protection of health - and its access - has represented contemporary debates that frequently affect its content, as well as its restrictions and scope. In fact, the enforceability of its protection is a pending issue for the Mexican State because, as the indicators reveal, it has not been able to overcome the old bond of constituting itself as a programmatic right and, consequently, valid at the time of budgetary availability. However, it is still a binding human right based on the express adoption of international human rights law in domestic law. Added to this, by itself the right to health protection also faces its own challenges, such is the case of its dependence on power. Therefore, the need for mechanisms that represent timely emergency exits for those who face the difficulties of becoming patients without constitutional and conventional access is assumed.

Desde el cambio constitucional paradigmático de los Derechos Humanos en el año 2011, las disposiciones normativas en la materia adquirieron una connotación de protección diferente al establecer una nueva esfera jurídica para las personas al amparo de los instrumentos internacionales. Bajo este orden jurídico de corte progresista es posible hablar del derecho a la salud para garantizar su acceso en el ámbito material. Al ser un derecho económico, social y cultural, el derecho de protección a la salud -y su acceso- ha representado debates contemporáneos que, con frecuencia, afectan su contenido, así como sus restricciones y alcances. De hecho, la exigibilidad de su protección es una asignatura pendiente para el Estado mexicano, ya que como los indicadores revelan no ha podido superar la vieja atadura de constituirse como un derecho programático y, en consecuencia, válido al compás de la disponibilidad presupuestal. Sin embargo, no deja de ser un derecho humano vinculante a partir de la expresa adopción del derecho internacional de los Derechos Humanos en el derecho interno. Aunado a ello, por sí mismo el derecho de protección a la salud también enfrenta sus propios desafíos, tal es el caso de su dependencia con el poder. Por ello, se asume la necesidad de mecanismos que represente salidas de emergencia oportuna para quienes enfrentan las dificultades de convertirse en pacientes sin acceso constitucional y convencional.
