El reconocimiento constitucional expreso del derecho a la información en Cuba

Abstract

The right to information has been treated by professors and academics as related to the subjects of classic liberties and the media. It is a progressive and interdependent right that contains its own characteristics (subjects, objects, sources, and principles) that distinguish it from those to which it was traditionally associated, such as the freedom of expression, thoughts and opinions. The Information and Communication Technologies (ICT), through the multiple tools that are available to the subjects, have energized the effective exercise of the right to information, have re-contextualized the scheme of traditional means of communication and have generated the need to create vast and sufficient legislation on the subject. Mexico is an international benchmark regarding the regulation of the right which is the object of this research, although the results in some indicators, such as corruption, do not reflect an effective correspondence between the legislative creation, its application, and the institutions. However, the country redefines its legal mechanisms to reverse this situation. Cuba has recognized the constitutional right of information in its recently promulgated Carta Magna. It went from significant absences regarding the human right to information to its regulation in the Constitution together with other related tax rights, which, although the fully exercise of their faculties is not allowed, constitute an incentive in the technological stage that the country begins to transit.

El derecho a la información, ha sido relacionado por catedráticos y académicos, con las libertades clásicas y con los medios de comunicación. Es un derecho progresivo e interdependiente, con características propias (sujetos, objeto, fuentes y principios) que lo singularizan de aquellos con los que tradicionalmente fue asociado como las libertades de expresión, de pensamiento y de opinión. Las Tecnologías de la Información y la Comunicación(TIC), mediante las múltiples herramientas que ponen al alcance de los sujetos, han dinamizado el ejercicio efectivo del derecho a la información, ha re-contextualizado el esquema de los medios tradicionales de comunicación y generado la necesidad de crear legislación vasta y suficiente en la materia. México es un referente internacional en cuanto a la regulación del derecho del de marras, aunque los resultados en algunos indicadores, como la corrupción, no reflejan una correspondencia efectiva entre - creación legislativa, su aplicación y las instituciones. El país perfecciona sus mecanismos jurídicos para revertir tal situación. Cuba ha reconocido el derecho constitucional de la información en su recién promulgada Carta Magna. Pasó de ausencias significativas en cuanto al derecho humano a la información, a regular en la Constitución, otros derechos tributarios de este, que, si bien no permiten ejercitar a plenitud sus facultades, constituyen un aliciente en esta etapa iusinformativa que comienza a transitar el país.
