El arte como derecho fundamental

Abstract

This research is a conjecture of three essential elements for human development, law, art and culture, all this through the creation of a new fundamental right, which is the art right. The creation of this new right forces the reader to understand the law as another element of the cultural exercise and the imaginative constructions that the human being has made throughout history, giving an opening to be able to think of art as a fundamental legal element, which in turn rethinks the vision and current exercise of cultural rights, giving a more accurate option to generate a true artistic exercise in society.

La presente investigación es una conjetura de tres elementos esenciales para el desarrollo humano, el derecho, el arte y la cultura, todo esto a través de la creación de un nuevo derecho fundamental, que es el derecho al arte. La creación de este nuevo derecho obliga al lector a comprender al derecho como un elemento más del ejercicio cultural y las construcciones imaginativas que ha hecho el ser humano a lo largo de la historia, dando una apertura para poder pensar al arte como un elemento jurídico fundamental, que a su vez replantea la visión y ejercicio que se tiene actualmente de los derechos culturales, dando una opción más certera para generar un verdadero ejercicio artístico en la sociedad.
