El derecho a la información y las excepciones personales. Análisis de sus fronteras: la salud de los gobernantes a la luz de la era iusinformativa

Abstract

The right to be informed and personal exceptions. Analysis of its borders: The health of the rulers in the light of the iusinformativa era, is a research work carried out to expose the need of citizens for their right to information regarding the personal exceptions of a specific person as it is in this investigation, the first president, call himself Republic President. This investigation will take us from the basic principles of the information rights, such as the analysis of each of its aspects related to the subject, its legal foundations, the doctrine and the main currents of thought of the authors who have studied said right. After that we will find its counterpart and at the same time the right that complements it, which are the privacy rights, intimacy and its most intimate spheres, all with the aim of knowing the opposable aspect to the right of information to analyze both rights and to have the complete panorama from its ends, just as it was done with respect to the information right, also with respect to private spheres, we will study the doctrines that were considered relevant for this study and the laws that support said rights. Once the extremes of these rights have been studied, their relationship and the limits between the two rights are analyzed, trying to highlight in certain cases mentioned, what is the importance of each one and in specific cases which would be prevailing in the event that they were confronted, all of the above based on current regulations and motivated by the most appropriate reasoning for said problem.

El derecho a la información y las excepciones personales. Análisis de sus fronteras: La salud de los gobernantes a la luz de la era iusinformativa, es un trabajo de investigación realizado para exponer la necesidad de la ciudadanía de su derecho a la información respecto de las excepciones personales de una persona en específico como es en el caso de esta investigación, el primer mandatario, llámese Presidente de la República. Esta investigación nos llevará desde los principios básicos del derecho a la información, como lo es el análisis de cada una de sus vertientes relacionadas con la temática, sus fundamentos legales, la doctrina y las principales corrientes de pensamiento de los autores que han estudiado dicho derecho. Posterior a ello encontraremos sus contrapartes que son los derechos a la privacidad, a la intimidad y sus esferas más íntimas, todo con el objetivo de conocer la vertiente oponible al derecho a la información con la finalidad de analizar ambos derechos y tener el panorama completo desde sus extremos, así como se realizó respecto del derecho a la información, también respecto de las esferas privadas estudiaremos las doctrinas que se consideraron pertinentes para este estudio y las leyes que fundamentan dichos derechos. Una vez estudiados los extremos de dichos derechos se procede a analizar su relación y los límites que hay entre ambos derechos procurando resaltar sobre ciertos casos mencionados, cuál es la importancia de cada uno y en casos específicos cuál sería prevaleciente en el caso de que se confrontaran, todo lo anterior fundamentado de acuerdo a la normatividad vigente y motivado por los razonamientos más adecuados a dicha problemática.
