To carry out this research work, I have made a historical journey of the rights of the child at the international and national level. Its inclusion as a superior interest in the Political Constitution of the United Mexican States, in its secondary laws and application regulations that give life to the constitutional context, in addition to analyzing the principles of equality and non-discrimination that should contribute to the integral development of the child. The Children's Stays of the Institute of Security and Social Services of State Workers, provide services to the daughters and sons of workers as a labor benefit that gives life to the social security established within the same supreme norm in its article 123, up to 6 years of age, terminating the provision in the absence of a fee called extension of service. Discriminating against children by age to complete their preschool education and failing to comply with the pro persona principles, progressivity and the best interests of the child, mandated in the constitution and international treaties, since the children who turned 6 years old during the months of January to June of the year 2022, for having been born during the year 2016, for this reason it will be the mothers or fathers who are beneficiaries of the service who must additionally carry out the payment of 25% twenty-five percent of the unit cost of a child in an ISSSTE Child Care Center, issued by the ISSSTE Board of Directors, as established in article 12 of the Regulations.
Para llevar a cabo este trabajo de investigación, he realizado un recorrido histórico de los derechos del niño en el ámbito internacional y nacional, además la inclusión del interés superior en la Constitución Política de los Estados Unidos Mexicanos, en sus leyes secundarias y reglamentos de aplicación que dan vida al contexto constitucional, además de analizar los principios de igualdad y no discriminación que deben de coadyuvar en el desarrollo integral del niño. Las Estancias Infantiles del Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado, brindan servicio a las hijas e hijos de los trabajadores como una prestación laboral que da vida a la seguridad social establecida dentro de la misma norma suprema en su artículo 123, hasta los 6 años de edad, dando por concluida la prestación a falta de una cuota denominada como extensión del servicio. Discriminando a los niños por edad para concluir su educación preescolar y faltando a los principios pro persona, progresividad y el interés superior del niño, mandata en la constitución y tratados internacionales, toda vez que los niños que cumplieron 6 años de edad durante los meses de enero a junio del año 2022, por haber nacido durante el año 2016, por tal motivo serán las madres o padres beneficiarios del servicio los que deberán de realizar de forma adicional el pago del 25% veinticinco por ciento del costo unitario de niño de una Estancia Infantil del ISSSTE, emitido por la Junta Directiva del ISSSTE, tal como lo establece el artículo 12 del Reglamento.
