It was also of great importance to talk about the private life where the concept was given, and as well as the areas that are protected by this right to privacy, as well as the recognition that it has in local and federal legislation and in international treaties. It is also essential to talk about the reparation of moral damage, as well as the ways of reparation, it also talks about the types of civil, criminal and administrative responsibilities. And finally, they analyze the cases of Ingrid Escamilla, Olimpia Merlo and finally that of a young man who was electrocuted in a hotel in Acapulco, these cases are of transcendence since in the first one it is about the responsibility of public servants regarding the leaks of images of the scene and as well as the inert body of Ingrid Escamilla. And as far as the second sees the violation of his private life when an intimate video was disseminated, and ending with the analysis of the case a figure called punitive damage is born, which talks about the reparation of moral damage.
Para abordar sobre el daño moral por la vulneración o transgredir la vida privada, en el ejercicio de la libertad de expresión, fue primordial hablar sobre la libertad de expresión, en el cual se definió su concepto, así como su reconocimiento en el marco legal federal y de los instrumentos internacionales. Así mismo fue de gran importancia hablar sobre la vida privada en donde se dio el concepto, y así como las áreas que están protegidas por este derecho a la vida privada, así mismo el reconocimiento que se tiene en el marco regulatorio legal local, federal y en los instrumentos internacionales. También es fundamental hablar sobre la reparación del daño moral, así como las vías de la reparación, también se habla sobre los tipos de la responsabilidades tanto civil, penal y administrativa. Y por último el analizan los casos de Ingrid Escamilla, y el de Olimpia Merlo y por último el de un joven que fue electrocutado en un hotel de Acapulco (amparo directo 30/2023), por lo que estos casos son de transcendencia ya que en el primero es sobre la responsabilidad de los servidores públicos respecto a las filtraciones de imágenes de la escena y así como del cuerpo inerte de Ingrid Escamilla. Y por lo que ve al segundo la vulneración de su vida privada al ser difundido un video íntimo, y finalizando con los análisis del caso nace una figura llamada daño punitivo, lo cual habla sobre la reparación del daño moral.
